Terms of Use — Get Gets

Ben Reyes (“we,” “us,” or “our”) operates the Get Gets mobile application (the “App”). These Terms of Use (“Terms”) govern your access to and use of the App. By creating an account, posting content, or otherwise using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your region) to use the App. By using the App, you represent that you meet this requirement and that you have the legal capacity to agree to these Terms.

Your account

You sign in with your mobile phone number, verified by SMS. You are responsible for the activity that happens under your account and for keeping access to your phone number secure. Tell us at benreyes@sunnyridgelabs.com if you believe your account has been used without your permission.

What Get Gets is

Get Gets lets people post a single recommendation (“a get”) for the best dish to order at a restaurant, along with a photo taken at that location, and lets others endorse (“co-sign”) those recommendations. You are solely responsible for the content you post.

Your content and license

You keep ownership of the photos and text you post. By posting content in the App, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content within the App and for operating, promoting, and improving the App. This license ends when you delete the content or your account, except for copies retained as required by law or already shared with others.

You represent that you have the rights to the content you post, that it is truthful (including that you were at the location when you posted), and that it does not violate these Terms or any law.

Zero tolerance for objectionable content and abusive users

There is no tolerance for objectionable content or abusive behavior on Get Gets. You agree that you will not post, share, or transmit any content, and will not engage in any conduct, that:

is unlawful, fraudulent, or misleading (including fake, paid, or off-location posts);
is hateful, harassing, threatening, or bullying, or that promotes violence or discrimination against any person or group;
is sexually explicit, obscene, or pornographic;
depicts or promotes the abuse or endangerment of minors;
infringes anyone’s intellectual property, privacy, or other rights;
is spam, or is intended to manipulate co-signs, rankings, or other users; or
impersonates any person or misrepresents your affiliation with anyone.

By using the App, you also agree to our Community Standards, which are these rules. We may remove content and suspend or permanently remove accounts that violate them.

Reporting and moderation

We give every user tools to keep the community safe:

Report — you can report any post or user directly in the App.
Block — you can block any user in the App, which hides their content from you and yours from them; blocked users can be reviewed and unblocked in your settings.

We review reports of objectionable content and abusive behavior and will act on violations — including removing the content and suspending or ejecting the responsible user — within 24 hours. We may take these actions with or without notice and at our sole discretion.

Prohibited conduct

In addition to the content rules above, you agree not to:

use the App for any illegal purpose or in violation of any law;
interfere with, disrupt, or attempt to gain unauthorized access to the App, our systems, or other users’ accounts;
scrape, harvest, or collect data from the App except as expressly permitted;
reverse engineer, decompile, or attempt to extract source code from the App, except where that restriction is prohibited by law; or
use bots, scripts, or automated means to create accounts, posts, or co-signs.

Location and posting

Posting a get requires that you are physically at the location, confirmed by your device’s location. Falsifying your location or posting about a place you are not at violates these Terms.

Termination

You may stop using the App and delete your account at any time in the App (You tab → Delete account). We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or to protect the App or its users. Sections that by their nature should survive termination (including content license grants already exercised, disclaimers, and limitations of liability) will survive.

Intellectual property

The App, including its design, features, logos, and content we provide, is owned by us and protected by law. These Terms do not grant you any right to our trademarks or branding.

Disclaimers

The App and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Recommendations in the App are the opinions of other users, not us, and we do not guarantee the quality, safety, or availability of any restaurant or dish. Use the App at your own risk.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or related to your use of the App. Our total liability for any claim relating to the App will not exceed one hundred U.S. dollars ($100).

Apple App Store terms

These Terms are between you and Ben Reyes only, and not with Apple Inc. (“Apple”). Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support for the App. Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or intellectual property claims; any such claims are governed by these Terms and applicable law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.

Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules, except where your local law requires otherwise.

Changes to these terms

We may update these Terms from time to time. We will post the updated version here and revise the “Last updated” date above. Your continued use of the App after changes take effect means you accept the updated Terms.
